Welcome to SKIRN Club. These Terms of Service ("Terms") govern your access to and use of the SKIRN Club website, mobile applications, facilities, and services (collectively, the "Services"). Please read these Terms carefully before using our Services.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Agreement to Terms
By accessing or using our Services, you confirm that:
- You have read and understand these Terms
- You agree to be bound by these Terms
- You are at least 13 years of age (users under 18 must have parental consent)
- You have the legal authority to accept these Terms
If you are accessing or using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.
2. Definitions
In these Terms, the following definitions apply:
- "Account" means the account created by a User to access and use the Services.
- "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
- "Member" means a User who has purchased a membership to access SKIRN Club facilities and services.
- "Membership" means the paid subscription that provides access to SKIRN Club facilities and services.
- "SKIRN Club," "we," "us," or "our" refers to the SKIRN Club organization and its operators.
- "Services" means the SKIRN Club website, mobile applications, facilities, events, and services provided by SKIRN Club.
- "User" means an individual who accesses or uses the Services.
- "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.
3. Account Registration and Use
3.1 Account Creation
To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.
3.2 Age Requirement
You must be at least 13 years old to create an Account and use our Services. Users under 18 years of age must have the consent of a parent or legal guardian. By creating an Account, you represent and warrant that you meet these age requirements.
3.3 One Account Per User
You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.
3.4 Account Termination
We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.
4. Membership Terms
4.1 Membership Options
SKIRN Club offers various membership options with different features, access levels, and pricing. Current membership options and pricing are available on our website or at our facilities.
4.2 Payment Terms
Membership fees are charged in advance on a monthly, quarterly, or annual basis, depending on the membership option selected. By purchasing a membership, you authorize us to charge the applicable membership fee to your designated payment method.
4.3 Automatic Renewal
Memberships automatically renew until canceled. You can cancel your membership at any time by logging into your account settings or contacting customer service. If you cancel, you may continue to access the Services until the end of your current billing period, but you will not receive a refund for the current billing period.
4.4 Price Changes
We may change our membership fees from time to time. If we change our membership fees, we will provide notice of the change on our website or by email at least 30 days before the change takes effect.
4.5 Membership Rules and Etiquette
As a Member, you agree to follow all rules and etiquette guidelines established by SKIRN Club, including but not limited to:
- Treating all staff and other Members with respect
- Using equipment and facilities responsibly
- Following all posted rules and staff instructions
- Maintaining appropriate behavior and language
- Adhering to all health and safety protocols
Violation of these rules may result in suspension or termination of your membership without refund.
5. Facility Use
5.1 Access and Hours
Access to SKIRN Club facilities is limited to Members with active memberships during posted operating hours. We reserve the right to modify operating hours with reasonable notice.
5.2 Equipment Use
Members must use all equipment according to its intended purpose and follow all posted instructions. Any damage to equipment caused by improper use may result in charges for repair or replacement.
5.3 Reservations
Some services and facilities may require advance reservations. Members must follow all reservation policies, including cancellation policies. Repeated no-shows for reservations may result in reservation privileges being suspended.
5.4 Personal Property
SKIRN Club is not responsible for any loss, theft, or damage to personal property brought into our facilities. Members are encouraged to use provided lockers for storing valuables.
5.5 Prohibited Activities
The following activities are prohibited in SKIRN Club facilities:
- Unauthorized commercial activities or solicitation
- Use of illegal substances
- Possession of weapons
- Harassment or intimidation of others
- Damaging or defacing property
- Any activity that disrupts the experience of other Members
6. Event Participation
6.1 Registration
Events may require advance registration and may have additional fees. By registering for an event, you agree to follow all event-specific rules and guidelines.
6.2 Cancellation Policy
Event registration cancellations must be made according to the cancellation policy specified for each event. Some events may have non-refundable registration fees or limited refund windows.
6.3 Event Conduct
When participating in SKIRN Club events, you agree to:
- Follow all rules of fair play and good sportsmanship
- Comply with all event staff instructions
- Respect other participants, spectators, and staff
- Use equipment and facilities as directed
6.4 Event Changes or Cancellations
SKIRN Club reserves the right to change event details or cancel events due to unforeseen circumstances. In case of cancellation by SKIRN Club, registration fees will be refunded or credited according to our refund policy.
6.5 Media Release
By participating in SKIRN Club events, you grant us permission to use photographs, videos, and recordings of you for promotional purposes unless you specifically opt out in writing.
7. Content and Intellectual Property
7.1 SKIRN Club Content
Unless otherwise indicated, the Services and all content and materials on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the property of SKIRN Club or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. This license is subject to these Terms and does not include:
- The right to modify, reproduce, distribute, or create derivative works based on the Services or Content
- The right to use the Services for any commercial purpose
- The right to access or use the Services in a way that could damage, disable, or impair the Services
- The right to attempt to gain unauthorized access to any part of the Services
7.3 User Content
You retain ownership of any User Content you submit, post, or display on or through the Services. By submitting, posting, or displaying User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and promoting the Services.
7.4 Content Restrictions
You agree not to post, upload, or share User Content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property right
- Contains software viruses or any other computer code designed to interfere with the functionality of any computer system
- Constitutes unauthorized or unsolicited advertising, junk or bulk email (spam)
- Contains private or personal information about another person without their consent
- Impersonates any person or entity or otherwise misrepresents your affiliation
7.5 Content Removal
We reserve the right, but are not obligated, to monitor, review, and remove any User Content at our sole discretion, including User Content that violates these Terms or is otherwise objectionable.
8. Prohibited Activities
You agree not to engage in any of the following prohibited activities in connection with the Services:
- Violating any applicable law, regulation, or these Terms
- Using the Services for any illegal purpose
- Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services
- Using any robot, spider, crawler, scraper, or other automated means to access the Services
- Bypassing or circumventing measures designed to prevent or limit access to any portion of the Services
- Taking any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure
- Collecting or harvesting any personally identifiable information from the Services
- Impersonating another person or otherwise misrepresenting your affiliation with a person or entity
- Interfering with the proper functioning of the Services
- Engaging in any harassing, intimidating, predatory, or stalking conduct
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SKIRN CLUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR THAT ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SKIRN CLUB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, SALES, GOODWILL, USE OF CONTENT, IMPACT ON BUSINESS, BUSINESS INTERRUPTION, LOSS OF ANTICIPATED SAVINGS, LOSS OF BUSINESS OPPORTUNITY) HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, BREACH OF STATUTORY DUTY, NEGLIGENCE OR OTHERWISE, EVEN IF SKIRN CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR COULD HAVE FORESEEN SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF SKIRN CLUB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS, RELATING TO THE SERVICES WILL BE LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY; OR (B) 100 PLN.
THE LIMITATIONS AND EXCLUSIONS ALSO APPLY IF THIS REMEDY DOES NOT FULLY COMPENSATE YOU FOR ANY LOSSES OR FAILS OF ITS ESSENTIAL PURPOSE.
11. Indemnification
You agree to indemnify, defend, and hold harmless SKIRN Club, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you or any activity related to your Account (including negligent or wrongful conduct) by you or any other person accessing the Services using your Account.
12. Termination
We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Services or contact us to request Account deletion.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
14. General Provisions
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the Polish Court of Arbitration, which rules are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Warsaw, Poland. The language of the arbitration shall be Polish or English.
14.3 Waiver and Severability
The failure of SKIRN Club to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
14.4 Entire Agreement
These Terms constitute the entire agreement between you and SKIRN Club regarding our Services, and supersede and replace any prior agreements we might have had between us regarding the Services.
14.5 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without SKIRN Club's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. SKIRN Club may freely assign or transfer these Terms without restriction.
14.6 Notices
Any notices or other communications provided by SKIRN Club under these Terms, including those regarding modifications to these Terms, will be given by posting to the Services and/or through other electronic communication. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
